I was named, in my official capacity as Executive Deputy Commissioner of the New York State Department of Health, as a co-respondent in a former special proceeding challenging a decision and order of the Administrative Tribunal Appeal of the New York State Department of Health. 4020 State Route 42 Gas Corp. v. N.Y. State Dep’t of Health, No. E2021-789 (N.Y. Sup. Ct. Aug. 26, 2021) (order transferring the matter to the Appellate Division, Third Department). The case has been closed.
